Order passed by the Chairperson, West Bengal College Service Commission dated December 2, 2022 has been placed in Court.

A copy of the same has been handed over to the learned advocate representing the petitioner in Court today. The prayer of the petitioner has been rejected on three grounds.

According to the petitioner, the said grounds cannot be taken up at this stage for rejecting the claim of the petitioner.

The Court is afraid that the legality of the grounds taken to reject the claim of the petitioner cannot be a matter to be adjudicated in the contempt proceeding. Accordingly, no further order can be passed in the contempt application.

It will be open for the petitioner to challenge the order passed by the Chairperson on December 2, 2022 before the appropriate forum, if so advised.

The contempt application stands disposed of.

The reasoned order dated December 2, 2022 be retained with the records.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
