Kalyan Brata Maity v. Khuku Maity
C.R.R 2273 of 2001 D/L 69 August 23, Bpg.
In Re: An application under Section 482 of the Code of Criminal Procedure;
Sri Kalyanbrata Maity
Versus
The State of West Bengal and another The present revisional application was preferred challenging the notice issued in connection with Case No.M-655 of 2000 wherein the petitioner was directed to be present before the learned Judicial Magistrate, Diamond Harbour on 21.09.2001. The proceeding referred to is under Section 125 of the Code of Criminal Procedure. I do not find any reasons or issues which have been canvassed in this revisional application for interference by this Court while exercising its inherent jurisdiction. Further, the records of the revisional application reflect that the same is yet to be admitted.
Having regard to the passage of time which has lapsed, which is more than 20 years, I am of the opinion that there is no scope for interference.
Accordingly, CRR 2273 of 200s1 is dismissed.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
