The petitioner is serving as Field Junior Engineer in the Paschim Banga Samagra Siksha Mission.

She was posted in Purbasthali with additional charge of Raniganj. She was transferred to Paschim Bardhaman by the impugned order of transfer dated May 22, 2023.

As the writ petition remained pending for more than two-and-a-half years, application (CAN No.1 of 2026) has been filed by the petitioner seeking for a direction upon the respondents to retransfer her to her previous place.

The petitioner has mentioned that her present place of work is very far off from her residence at Kalyani, Nadia. She has a minor daughter, and it is difficult for her to properly handle the official work along with taking care of her minor daughter.

Without entering into the merits of the prayer of the petitioner seeking transfer, as it appears that nearly three years will elapse from the impugned

order of transfer dated May 22, 2023, accordingly, the instant writ petition and the connected application stand disposed of by directing the State Project Director, Paschim Banga Samagra Siksha Mission to take a decision on the petitioner's prayer seeking retransfer or posting her to any place which is close to her residence in accordance with the prevailing transfer Rule, at the earliest but positively within a period of eight weeks from the date of communication of this order.

A reasoned order shall be passed and communicated to the petitioner forthwith.

Learned counsel for the petitioner shall submit a copy of the representation seeking consideration along with all supporting documents to the aforesaid respondent at the time of communicating this order.

The writ petition and CAN No.1 of 2026 stand disposed of.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
