As per direction passed by the Court on 24th June, 2022, an inspection was conducted at the subject premises. During inspection it was observed that, there is one filter water domestic connection in the said premises. The premises is getting filter water supply through reservoir and one stand post (branch connection). The filter water pressure is low when it supplies to both reservoir and the stand post at a time and the filter water pressure is normal when the supply is either in the reservoir or the stand post. It has been noticed that the service pipe is old and worn out.

It appears from the submissions made on behalf of both the parties and on perusal of the inspection report which has been filed in Court today signed by the Sub-Assistant Engineer/W.S./G, Assistant

Engineer (C)/W.S./G and the Executive Engineer/W.S./Central, Kolkata Municipal Corporation dated 13th July, 2022 that there is already an existing ferrule from where the water is supplied in the reservoir.

The petitioner being a tenant and the private respondent being the landlord of the said premises collect water from the said water connection. The report mentions that the service pipe is old and worn out.

It will be open for the parties to take steps to repair the service pipe upon compliance of all necessary formalities and in accordance with law.

The report filed by the Kolkata Municipal Corporation is taken on record.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
