1. Learned counsel for the petitioner seeks permission to withdraw the present petition subject to the condition that the cost imposed by the learned Additional Sessions Judge, 2nd Court, Contai, Purba Medinipur vide order dated 30th January, 2025 is waived.

2. Learned counsel for the opposite party has graciously not opposed the waiving of cost.

3. I have considered the submissions.

4. In the facts and circumstances of this case the cost imposed vide order dated 20th May, 2025 by learned additional Sessions Judge, 2nd Court, Contai, Purba Medinipur is waived. The impugned order is upheld and modified only to the extent of waiving of the cost.

5. This petition is disposed of.

6. Upon request of the opposite party learned Trial Court is requested to dispose of the matter expeditiously.

7. It is made clear that all the contentions are kept open to be raised during the trial.

8. Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities.
