10.12.2021 Sl. No.43 akd [Rejected] C. R. M. 6348 of 2021 [via video conferencing] In Re: An application for bail under Section 439 of the Code of Criminal Procedure filed on 21.09.2021 in connection with Tamluk Police Station Case No. 52 of 2019 dated 24.01.2019 under Sections 302/120B of the Indian Penal Code.

And In Re: Suparna Das @ Fulti ... ... Petitioner Mr. Soumik Ganguli Mr. Sourat Nandy ... ... for the petitioner Mr. Binay Panda Ms. Puspita Saha ... ... for the State Petitioner renews her prayer for bail. It is submitted on behalf of the petitioner that she is in custody for about two years and nine months.

Learned advocate appearing for the State opposes the prayer for bail and submits that the petitioner had murdered her husband. Finger prints on the offending weapon matches with that of the petitioner. Trial has already commenced.

We have considered the materials on record. There are materials pointing to the guilt of the petitioner. Petitioner was present in the house when her husband was murdered. On her leading statement, weapon of offence was recovered. Finger prints on the seized weapon matched with that of the petitioner. In view of the aforesaid clinching materials, we are not inclined to grant bail to the petitioner at this stage. The application for bail is thus rejected.

We however, direct the trial court to proceed with the trial with utmost expedition and conclude the same at an early date preferably

within one year from the next date fixed for recording of evidence without granting unnecessary adjournment to either of the parties. (Bivas Pattanayak, J.) (Joymalya Bagchi, J.)
