12.07.2022 sdas rejected C.R.M.(DB) No. 2247 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Gazole Police Station Case No. 401 of 2022 dated 29.05.2022 under Section 306 of the Indian Penal Code.

And In Re : Samir Saha ..... petitioner Mr. Mrityunjoy Chatterjee Mr. Kaushik Dey ... for the petitioner Mr. Atif Ahmmed Siddiqui ... for the State Learned Counsel appearing for the petitioner submits that his client is in custody for 40 days. It is also submitted that the petitioner did not abet suicide of the victim. Learned Counsel appearing for the State opposes prayer for bail.

We have considered the materials on record. Statements of witnesses show that the petitioner had tried to outrage the modesty of the victim. As a consequence, victim committed suicide.

In view of the aforesaid materials on record and nature of offence, we are not inclined to grant bail to the petitioner at this stage.
