Learned advocate appearing for the petitioner submits that he has purchased a property, raised construction and at the time of construction of the boundary wall has been resisted by the private respondents.

Learned advocate for the private respondents submits that a title suit is pending being T.S. No. 197 of 2024 before the learned Civil Judge (Junior Division), 1st Court, Purba Bardhaman.

State has submitted a report. Report reflects that police authorities are well aware regarding the nature of dispute existing between the

petitioner and the private respondents and to that effect, have drawn up proceedings under section 126/135 of the BNSS.

I have considered the submissions of the respective parties. Having regard to the fact that the resistance is with regard to erection of boundary wall, the same is not the domain of the police authorities.

Police authorities would only oversee that there is no untoward incident as also breach of the peace at the behest of the petitioner and the private respondents who are at loggerheads, arising from the strained relationship existing between them. With the aforesaid observations WPA 14339 of 2025 is disposed of.

Report so submitted be kept with the record. A copy of the report be circulated amongst all the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
