The limited grievance of the petitioner is that a frivolous case has been filed under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 by the petitioner.

However, although the hearing has been concluded by respondent no.3, the respondent no.3 (Sub Divisional Officer, Alipore) has not yet passed any order on the said application.

Learned counsel appearing for the State submits that the application filed by the petitioner before the SDO is not maintainable in law, since the yardsticks of the 2007 Act are not satisfied in case of the petitioner. Be that as it may, without going into the question of maintainability of the application of the petitioner before the SDO, WPA 14831 of 2022 is disposed of by directing the respondent no.3, that is, Sub Divisional Officer at Alipore to decide the application filed by the petitioner

under the 2007 Act as expeditiously as possible, preferably within three weeks from date, in accordance with law.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
