The petitioner is directed to serve a copy of the revisional application upon Mr. Mitra, learned advocate, who ordinarily appears on behalf of the State. His appointment may be regularised by the concerned authorities.
Learned advocate for the petitioner submits that the case was registered in the year 2021 and on conclusion of investigation, charge-sheet was submitted in connection with Jadavpur PS Case No. 145 of 2021 dated 18.04.2021 under Sections 120B/420/406 IPC. The next date has been fixed on 1st September, 2023 for supply of copies. Having considered the fact that the next date is fixed almost 21⁄2 years for evidence of the case, I am of the view that the learned ACJM, Alipore would ensure regarding the supply of copies on 1st September, 2023 or within a fortnight thereafter.
Learned trial court would retain the proceedings or transfer the same to the jurisdictional Judicial Magistrate who would, after considering the charges, fix regular dates for the trial of the case.
Having regard to the fact that there are number of witnesses, learned Magistrate would at least fix a date once in every 6o days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. With the aforesaid observations, CRR 2256 of 2023 is disposed of.
Pending application, if any, is consequently disposed of.
