1. Nobody appears on behalf of the appellant.

2. State is represented.

3. In pursuance of the direction passed by this Court dated 11.04.2025, a report is submitted by the ASI of Police, P.S.- Durgapur indicating that during pendency of this appeal, the sole appellant/convict, Sri Pradhan Bankuria was expired in the year 2011.

But the family members of the said appellant/convict failed to produce any document regarding the death of the appellant.

4. As the sole appellant/convict has been expired during pendency of this appeal, the instant appeal stands abated against him.

5. Accordingly, the instant appeal be and the same is hereby dismissed as abated.

6. The report submitted by the concerned police station be kept with the record.

7. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.

8. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities. (Prasenjit Biswas, J.)
