The present appeal was preferred challenging the judgement and order dated 27.03.2019 and 29.03.2019 passed by learned Additional District and Sessions Judge, Diamond Harbour, South 24-Parganas in connection with Sessions Trial No. 14(08) 2016 corresponding to Sessions Case No. 03(04) 2016 wherein the learned trial court was pleased to convict the present appellant under Sections 341 and 307 of the Indian Penal Code and sentenced her to suffer simple imprisonment for one month for the offence under Section of the Indian Penal Code and simple imprisonment for five years and to pay a fine of Rs.10,000/- in default to suffer simple imprisonment for another six months for the offence under Section 307 of the Indian Penal Code.

Ms. Biswas, learned advocate appearing for the State has submitted a report. Let the said report dated 22.07.2024 be kept with the record.

The said report has been prepared by Inspector-inCharge, Diamond Harbour Police Station enclosing the document which has been forwarded by Superintendent,

Alipore Women's Correctional Home which reflects that on 08.08.2022 pursuant to the order passed by the Hon'ble Governor, the appellant has been released and a portion of the sentence has been remitted under Article 161 of the Constitution of India by the Hon'ble Governor. In view of the report so submitted, I am of the view that the present appeal has become infructuous.

Accordingly, CRA 421 of 2019 is disposed of.

Pending connected application is consequently disposed of.

Department is directed to send back the lower court records along with a copy of this order immediately to the learned trial court.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
