1. Affidavit-of-service filed in Court today be taken on record.

2. The instant writ application challenges an order of the Debts Recovery Tribunal-II at Kolkata dated 24th May, 2024.

3. The writ petition has been filed on the ground that the Debts Recovery Appellate Tribunal is not functioning and the Presiding Officer is not available there.

4. Counsel for the respondent Bank produces the cause list of today's Debts Recovery Appellate Tribunal. The same is kept with the record.

5. In that view of the matter, the instant writ petition is disposed of reserving liberty to the petitioner to challenge the order of the Debts Recovery Tribunal-II above before the Debts Recovery Appellate Tribunal at Kolkata on the selfsame ground and cause of action

and move the Debts Recovery Appellate Tribunal in the pending appeal being Diary No. 519 of 2024.

6. I make it clear that this Court has not entered into the rival contentions of merits of the order of the Debts Recovery Tribunal-II at Kolkata.

7. There will be no order as to costs.

8. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
