Mr. Somnath Naskar ... for the State The petitioner is aggrieved by the order dated 2nd September, 2021 passed by the District Controller, Food and Supplies, Malda whereby the application of the petitioner for being engaged on compassionate ground has been rejected. The rejection was made on the ground that the petitioner being the granddaughter of the deceased dealer does not qualify within the definition "family member" according to sub-clause (3) (l) of the West Bengal Kerosene Control Order as amended by the notification dated 4th June, 2021.

The relevant provision of the 4th June, 2021 amendment notification has been placed before this Court. It does not appear therefrom that the granddaughter is an eligible member to be treated as family in terms of the Control Order.

In view of the above, there is no apparent error in the impugned order.

The writ petition fails and is hereby dismissed.
