On the other hand, learned advocate for the private respondents submits that the business is being carried out legally and the petitioner with vindictive attitude and ulterior motive has been filing frivolous complaints with the police authorities.

State has submitted a report

which reflects that it has been contended on behalf of the learned advocate for the State that all the permissions are available with the private respondents except the permission/license required from the West Bengal Pollution Control Board.

The police authorities have conducted an enquiry. If particular authority has not granted permission and/or granted permission and/or laws do not allow to grant permission, the police authorities will act only on the basis of complaint of the statutory authority.

However, the petitioner would be at liberty to approach the appropriate authority for taking relevant steps in accordance with law.

With the aforesaid observations, WPA 14405 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
