1. The learned Counsel for the petitioner submits that the petitioner is innocent and all co-accused persons as that of the petitioner have been granted anticipatory bail. Claim on parity with the other co-accused who were enlarged on anticipatory bail in several matters including CRM (A) 1217 of 2024 on 10th April, 2024 is not being disputed on behalf of the State.

2. The learned Counsel for the State produces the case diary.

3. We have considered the materials on record. Dispute relates to title over immovable property. Co-accused have been granted pre-arrest bail. Petitioner is entitled to same relief.

4. Accordingly, we are inclined to grant anticipatory bail to the petitioner.

5. Accordingly, we direct that in the event of arrest the petitioner, namely, Hamid Sk @ S.K. Hamid @ Sutun Sk shall be released on bail upon furnishing a bond of Signed By :

Rs.10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on condition that he shall appear before the jurisdictional court and pray for regular bail within a period of four weeks from date.

6. The prayer for anticipatory bail of the petitioner is allowed.

7. Accordingly, the application for anticipatory bail is disposed of.
