For the State Mr. Atarup Banerjee, learned advocate appears for the petitioner referring to annexure P-3 at page 14 to the writ petition submits that, this is not the death certificate of Renuka Das, since deceased, in a statutory form. The Pradhan has to issue the death certificate in a statutory form otherwise the same will have no effect and value before the respective authorities before whom the same is required to be produced for various purposes for recording of the death of the deceased.

None appears for the Panchayat or its Pradhan, despite notice.

Considering the submissions made on behalf of the parties and upon perusal of the materials on record the concerned Pradhan, being the respondent

No. 6 herein is directed to issue the death certificate in the statutory form in the light of the document dated July 20, 2022 already issued by him, annexure P-3 at page 14 to the writ petition. The Pradhan shall do the needful positively within a period of two weeks from the date of communication of this order.

Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

On the above terms, this writ petition W.P.A 14622 of 2023 stands disposed of, without any order as to costs.

Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
