In the present application, the petitioner has sought for direction upon the learned Judicial Magistrate, 8th Court, Alipore for expeditious disposal of the Money Execution case no. 268 of 2020 filed under Section 20(6) of the Protection of Women From the Domestic Violence Act, 2005.

The prayer made by the petitioner is very innocuous and if it allowed, it will not cause prejudice to the opposite party. Moreover, the aforesaid prayer is quite justified in view of the fact that the said execution proceeding is pending since 2020. In such view of the matter, CRR 1943 of 2021 is hereby disposed of with a direction upon the learned Judicial Magistrate, 8th Court, Alipore or the Court-in-charge of the learned Judicial Magistrate, 8th Court, Alipore for expeditious disposal of the Money Execution case no. 268 of 2020 and to make every endeavour to dispose of the same preferably within a period of eight weeks from the date of communication of the order.
