Md Ohidul Islam v. State Of West Bengal
05-07-2024 (ct. no.28) KOLE CRM (DB) 1872 of 2024 In re: An application for bail under Section 439 of the Code of Criminal Procedure in connection with Suti Police Station Case No. 211 of 2023 dated 27.04.2023 under Sections 489B/489C/120B of the Indian Penal Code.
- A n d - In the matter of : Md. Ohidul Islam .... Petitioner.
Ms. Shabana Hasin, Ms. S. Akter Basu, Ms. Neha Roy, ... For the Petitioner.
Mr. Saibal Bapuli, Mr. S. Bapuli, ... For the State.
Order dictated in open court by Apurba Sinha Ray, J. Learned Advocate for the petitioner says that the petitioner is in custody for more than one year and two months and he has been framed. He says that there is no chance of conclusion of the trial at an early date. He prays for bail on any stringent conditions. Learned Advocate appearing for the State vehemently opposes the prayer for bail. According to him, fake Indian currency amounting to Rs. 94,000/- have been recovered from the possession of the petitioner. The charge is scheduled to be framed on July 8, 2024. He further submits that 15 fake Indian currency notes have been found from the house of the present petitioner. After going through the materials on record as well as the case diary, we find that there are sufficient incriminating materials against the present petitioner. Fake Indian currency notes have been recovered from his possession as well as from his house.
Crimes of these nature have an extremely adverse impact on the economy of the nation as a whole. In view of the incriminating materials on record, we are not inclined to allow the prayer for bail of this petitioner.
CRM (DB) 1872 of 2024 is, thus, dismissed.
We direct the learned Trial Court to conclude the trial after framing of charge as expeditiously as possible. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. ( Apurba Sinha Ray, J. ) ( Arijit Banerjee, J. )
