Santanu Benerjee v. Manmotho Nath Sarkar
20.02.2023 Court No.35 Item No. 31 CRR 1920 of 2015 Santanu Banerjee Vs.
Manmotho Nath Sarkar D.Hira Mr. Narayan Prasad Agarwala, Mr. Pratick Bose.
... for the petitioner Mr. Agarwala, learned Advocate is appearing for the State. However, no one is appearing for the petitioner or the private opposite party even at the second call. This is an old case and the petitioner has never been represented till the date, the matter is pending in the list, since 9th January, 2023. Hence, the matter is taken up for disposal on merit.
The petitioner in this case has prayed for quashing of the proceeding being Criminal Case No. 87 of 2015 dated 21st April, 2015 under Sections 406/418/420 of the Indian Penal Code, now pending in the Court of Judicial Magistrate, 2nd Court, Sealdah, South 24 Parganas.
The petitioner has stated that the complaint has not disclosed any cognizable offence against him and the case is not maintainable against him.
On perusal of the entire materials available on record and the grounds made up by the petitioner I am constrained to find that the grounds thereof are not sufficient and cogent enough to warrant this Court's interference into the impugned order. Hence, in my considered opinion the revision is liable to be dismissed. Criminal Revision being CRR 1920 of 2015 is dismissed. All pending applications, if any, are consequently disposed of.
Certified website copies of this order, if applied for, be supplied to the parties subject to compliance with all the requisite formalities. (Rai Chattopadhyay, J.)
