The petitioner who is the complainant before the learned trial Court in Case no. CN-456 of 2021 under Section 138 of the Negotiable Instruments Act, 1881 seeks expeditious disposal of the case.

It appears that the case is pending since 2021 and 31st July, 2024 has been fixed by the learned trial Court for plea. Upon consideration of the submission made on behalf of the petitioner, this Court is inclined to direct the learned Metropolitan Magistrate, 9th Court, Calcutta, to record plea on the next date fixed before him. If the accused is absent on the said date, the learned trial Court shall take necessary steps to ensure presence of the accused before him. The learned trial Court shall dispose of the proceeding pending before him within six months from the date of recording the plea. With the aforesaid directions, the application, being CRR 2384 of 2024 is disposed of.
