1. Heard learned Counsel for both the parties.

2. The present petitioner is stated to be the assailant so far as the alleged grievous injury caused to the victim is concerned.

3. Regard being had to the seriousness of the assault and the resultant injury, we are not inclined to exercise our discretion in favour of the petitioner under Section 438 Cr.P.C.

5. Accordingly, the prayer for the anticipatory bail is rejected.
