This is an application praying for a direction upon the concerned DPI to approve the proposal of the College Authorities for compassionate appointment of the petitioner. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner's father was the approved Instrument Keeper in the department of Physics of Vidyasagar

College for women. He died in harness on 30.08.2010. On 25.09.2010, an application was made by the mother of the petitioner praying for compassionate appointment for him under the died in harness category. On 25.11.2013, the Governing Body recommended the case of the petitioner to the Director of Public Instruction. On 14.02.2014, the Director of Public Instruction asked the Principal of the Vidyasagar College for Women to submit some documents. Such documents were supplied. Thereafter, there has been no response from the end of the Director of Public Instruction. A similarly circumstanced candidate was given appointment after intervention by this Court.

Learned counsel appearing on behalf of the State submits that in the event the petitioner's case is pending consideration before the Director of Public Instruction, the same would be considered in accordance with law.

It appears that the petitioner's case for appointment to a post under the category died in harness is pending before the Director of Public Instruction.

The petitioner's contention is that a similarly circumstanced candidate was given appointment. In view of the above discussions, let the respondent no.2 Director of Public Instruction consider the petitioner's case for

appointment in accordance with law and as expeditiously as possible, preferably within a period of eight weeks from the date of communication of this order.

With these observations, the writ petition is disposed of. Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J) ssi
