The petitioner/wife is aggrieved by the long pendency of the appeal since the year 2019. The appeal is pending before the learned Additional Sessions Judge, Fast Track Court, Chandannagore, Hooghly.

Learned advocate submits that the orders so issued under Section 23 of the PWDV Act are also not being complied with by the appellant.

In view of the anxiety expressed by the petitioner/wife regarding the pendency of the appeal, I am of the view that such anxiety is justified.

It has been brought to the notice of the Court that the next date is fixed on 6th July, 2023. Learned appellate court would fix on and from 6th July, 2023 one date on each every fortnight and complete the appeal by 31st August, 2023. The learned appellate court would see the conduct of the parties and make his necessary comments while disposing of the appeal.

With the aforesaid observations, CRR 2268 of 2023 is

disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
