Ahmed, learned advocate appearing for the petitioner prays for transfer of Matia Police Station Case No.52/21 dated 12.02.2021 which was subsequently treated as Dum Dum Police Station Case No.419/21 dated 01.04.2021 under Sections 498A/ 406 of the Indian Penal Code. Petitioner has approached this Court at a stage when the investigation of the case was under progress. Learned advocate appearing for the private opposite party points out that subsequently charge-sheet has been submitted and charge has already been framed on 22nd September, 2022. Learned Court has also fixed dates for examination of witnesses.

Mr. Sur, learned advocate appears on behalf of the State. Having regard to the change of circumstances presently, I am of the opinion that no interference is called for, at this stage. However, if subsequently new events crop up, the petitioner will be at liberty to invoke the jurisdiction of this Court.

With the aforesaid observations, C.R.R. 1947 of 2021 is disposed of. Pending applications, if any, are consequently disposed of.
