Learned advocate for the petitioner is present. Ms. Faria Hossain, learned advocate appearing for the State has submitted a report prepared by the Officer-inCharge, Polba Police Station, Hooghly. Let the said report dated 31.07.2022 be kept on record.
The report reflects that the case was committed to the court of sessions and is awaiting order of the High Court. The order dated 20.07.2022 reflects that there was no interim order for a period of 14 years. However, because of pendency of this revisional application, learned trial court did not proceed with the trial of the case.
In view of the aforesaid, I am of the opinion that further pendency of this revisional application before this Court is unwarranted as the sessions court/trial court is in seisin of the matter. Having regard to the stage of the proceedings, I direct that the petitioner would be at liberty to canvass the
points agitated in this revisional application at the final stage of hearing of the sessions case.
With the aforesaid observations, the revisional application being CRR 2222 of 2007 is disposed of. All pending connected applications, if any, are consequently disposed of.
Department is directed to communicate this order to the learned trial court.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
