The learned advocate representing respondent Nos. 6 and 7 has referred to an order dated May 1, 2024, passed in WPA 3880 of 2024 (Sri Balai Mondal & Ors. v. The Howrah Municipal Corporation & Ors.). A perusal of the order dated May 1, 2024, clearly indicates that the said writ petition was filed to challenge a notice issued under Section 177(1) of the Howrah Municipal Corporation Act, 1980, concerning the

same premises. A Co-ordinate Bench disposed of the writ petition with a direction to the Howrah Municipal Corporation to take appropriate steps regarding the relevant construction. In light of the above, there is no necessity for this Court to issue a fresh order concerning the alleged unauthorized construction. It is understood that the Howrah Municipal Corporation will take the necessary actions in accordance with the law.

Accordingly, WPA 15639 of 2024 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
