The petitioners are the plaintiffs of the ejectment suit being Ejectment Suit No. 43 of 2006 subsequently renumbered as 460 of 2006 pending before the 1st Court of the learned Additional Civil Judge (Junior Division), Alipore, District 24-Parganas (South).

The petitioners are complaining inordinate delay in disposal of the said suit and are praying for a direction upon the learned Trial Judge for expeditious disposal of it.

Mr. Mondal, learned advocate appearing on behalf of the petitioners and submits that the evidence from the side of the petitioners is complete, only the cross-examination of the defendant is yet be completed. Mr. Mondal further submits that the

plaintiffs require only one date to complete the crossexamination of the defendant. Mr. Maurya, learned advocate appearing on behalf of the opposite party submits that his client challenging the veracity of Commissioner's report has already filed an application.

Be that as it may, a suit for ejectment filed in the year 2006 should not have been kept pending for more than fifteen years.

The learned Trial Jude is, therefore, requested to dispose of the said suit as expeditiously as possible, of course after resumption of normal functioning of the Court and in doing so, shall not grant any unnecessary adjournment to either of the parties. C.O. 1713 of 2021 is disposed of with the above terms without any order as to costs.
