The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with.
The minor son of the parties is in the custody of the mother/opposite party.
The father/petitioner to get back the said custody has initiated a proceeding under Section 25 of the Guardian and Wards Act, 1890 being Misc. Case No.151 of 2021 (Act VIII) pending before the 3rd Court of the learned Additional District Judge at Barrackpore, District : 24Parganas (North). The petitioner is praying a direction for expeditious disposal of the said proceeding.
Learned Advocate for the petitioner submits that the minor has developed some psychological problems and is under the
treatment, as such, the proceeding needs to be disposed of expeditiously.
It appears from the record that the witness action in the proceeding has started, therefore its disposal can be expedited.
The learned Trial Judge is requested to dispose of the said Misc. Case as expeditiously as possible preferably within a period of ten weeks from the date of communication of this order and in doing so shall not grant any unnecessary adjournment to either of the parties.
C.O. 2121 of 2024 is disposed with the above terms without any order as to costs.
Urgent photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
