The State of West Bengal Mrs. Shabana Hasin Mr. Aritra Kumar Thokdar .......For the Petitioner Mr. Madhusudan Sur, Ld. APP Ms. Trina Mitra ....For the State Petitioner submits that 10,000 bottles of cough syrup containing codeine phosphate was recovered from the exclusive possession of the present petitioner and that the petitioner is in custody for about 313 days and though the charge sheet submitted on 19th April, 2025 and the prosecution proposes to examine 14 witnesses but the trial has not yet commenced and as such it is unpredictable as to when the trial would conclude and considering his period of detention, he may be released on bail on any terms and conditions.

Learned counsel appearing on behalf of the State opposed the bail prayer contending that huge quantity of narcotic substance was recovered from the exclusive

possession of the petitioner and that if he is released on bail, there is serious chance of his abscondance. Having heard the learned counsel appearing on behalf of the petitioner and the State and that the restriction imposed under Section 37 of the NDPS Act clearly attracts in respect of the present petitioner, the prayer for bail is considered and rejected.

Accordingly, CRM (NDPS) 813 of 2025 is disposed of.
