On the basis of the complaint filed by one of the petitioners, Sonarpur P.S. Case No.153 of 2016 dated January 18, 2016 under Section 188 of the Indian Penal Code was registered. After completion of the investigation, a charge-sheet was filed against six accused persons vide charge-sheet no.566 of 2016.
On the basis of a written complaint of one Bapan Kumar Saha, who allegedly is the constituted attorney of the petitioners, Narendrapur P.S. Case No.954 dated August 5, 2021 under Sections 420/465/467/468/469 of the Indian Penal Code was registered on the allegation of execution of a false deed. The case is under investigation. One Tapan Kumar Biswas, another constituted attorney of the petitioners lodged a complaint on April 28, 2022 against some persons in connection with Title Suit No.190 of 2022. On the basis of such suit, Narendrapur P.S. Case No.412 of
2022 was registered. The FIR named accused persons were notified under Section 41A of the Code of Criminal Procedure for interrogation.
It appears that the written complaint of one of the petitioners has resulted in the filing of a charge-sheet. The investigation with regard to the complaint of Bapan Kumar Saha is in progress.
Under such circumstances, this Court does not find any reason to keep the writ petition pending. The police authorities have already taken steps. It is expected that the investigation of Narendrapur P.S. Case No.654 dated August 5, 2021 shall be expedited and reached to its logical conclusion. The police authorities shall keep a vigil in order to avoid law and order problems.
Accordingly, the writ petition is disposed of. However, there will be no order as to costs.
