Heard learned counsels for the parties.

The petitioners are in custody for more than a year and renew their prayer for bail.

Learned counsel for the petitioners submits that the petitioners are similarly circumstanced with the principal conspirator Sanjeet Singh @ Pappu @ Sanjit Singh who was granted bail by this Court earlier. Co accused have also been granted bail.

Learned counsel for the State opposes the prayer. I have considered the material on record. It appears that the 1st petitioner is one of the principal conspirators who contacted the sharp shooters, harboured them and brought them to the place of occurrence. He appears to be

actively involved in the chain of the alleged offence. With regard to the 2nd petitioner, the gait pattern in the CCTV footage has matched with that of the petitioner. The offending weapon has been recovered from the possession of the 2nd petitioner pursuant to his leading statement and has matched with the bullets recovered from the body of the victim.

Considering the extent of involvement of both the petitioners in the alleged offence, this Court is of the view that this is not a fit case where they can be released on bail. The petitioners are in custody for more than a year. Offence, if proved, shall attract mandatory life imprisonment. In view of the above, the prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
