Petitioner has approached this court since the accused after he was granted bail had been evading the process of law, warrant of arrest was issued.

The report reflects that in connection with Uttarpara PS Case No. 396/2022, charge sheet has already been submitted. However, since one of the accused had been absconding, the trial of the case could not progress in spite of charge sheet having been submitted before the jurisdictional court. In view of the accused evading the process of law, the Deputy Commissioner in-charge of Uttarpara Police Station would monitor the execution of the warrant of arrest, in case within a period of 30 days of the date of communication of

this order the accused is not traceable, prayers should be advanced before the jurisdictional court for execution of harsher process of law.

In case the absconding accused is not traceable after whole of the process is exhausted, the jurisdictional court in seisin of the matter would split up the trial after filing the case against the absconding accused.

With the aforesaid observations WPA 15898 of 2024 is disposed of.
