There are incurable defects in WPA (P) 238 of 2025.

Leave is given to withdraw the writ petition and file a fresh writ petition with the self-same cause of action.

In the event a writ petition is filed, the same should be listed along with other connected matters on the adjourned date.

However, we would like the response from the College and the State Administration with regard to the allegations and issues raised in paragraph 6 of this petition, in the event the said allegations and/or issues are also raised in the writ petition to be filed in terms of this order by the adjourned date.

Accordingly, the writ petition, being WPA (P) 238 of 2025, is dismissed as withdrawn.

Affidavit of service is taken on record.

It has been brought to the attention of the Court that few girl students of the same College have been shown in various channels and social media which is likely to create an impression that the female shown would be the victim whose identity should be preserved and not disclosed under any circumstances. It demeans the modesty of the victim and the female who have been shown with a mistaken identity. If required, an advisory shall be issued by the State Home Department to all the media houses and to lodge appropriate complaints if in the social media any such attempt is made to confuse the identity of the victim.

The State shall produce the case diary on the adjourned date.

The victim is represented by Mr. Yuvraj Chatterjee, Advocate-on-record led by Mr.

Arindam Jana, Advocate.

The petitioners are directed to serve copies of the writ petitions upon Mr. Yuvraj Chatterjee in course of this week.

11.

The victim shall be heard in both the writ petitions.

12.

The learned Counsel for the victim has submitted that she has been receiving all necessary support from the SIT.

13.

The matter stands adjourned till 10th July, 2025.
