...for the State Counsel for the petitioner submits that his client approached the local police station with a complaint against the private respondent that ingress and egress to his land is being blocked. It is submitted that the petitioner is in conflict with the private respondent since he belongs to the rival political party.

Counsel for the State submits that there are at least four chargesheets filed by the Mandir Bazar Police Station, in respect of the compliant of the petitioner and the private respondent against one another.

It is submitted that in respect of last complaint of the petitioner, proceeding under section 107 of the Cr.P.C. has been taken out. There is also TS Case No. 257 of 2018 now pending between the parties. Counsel for the petitioner, however, prays that the said title suit was advanced in respect of other plot of land being plot no. 368. This Court is of the view that the dispute between the petitioner and the private respondent being the subject matter in this proceeding

is purely civil and private in nature. There is no inaction on the part of the police. The petitioner may take appropriate steps before the Civil Court to obtain relief, if any, against the private respondent. The Officer-in-Charge, Mandir Bazar Police Station shall, however, ensure that there is absolutely no breach of peace in the aforesaid area.

The writ petition being WPA 15587 of 2021 is disposed of. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. (Rajasekhar Mantha, J.)
