Petitioner is aggrieved by the factum of being restrained because he is unable to raise the boundary wall.

According to the petitioner, police is unnecessarily interfering with such construction. I find that the representation which was made is of June, 2023.

State has submitted a report. Report reflects that a land dispute is prevailing with the private respondents, as such, the police authorities are unable to act without any specific order from an appropriate court of law. However, report reflects that at the relevant point of time, police authorities ensured that there is no breach of the peace and tranquility.

The incident complained of is more than 22 months ago, as such, I direct that in case any crisis

arise, police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the inimical relationship existing between the parties.

With the aforesaid observations, WPA 14677 of 2023 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
