This matter has been mentioned for correction of the order dated September 6, 2023. The Court had refused to transfer the suit but had directed the application for maintenance pendente lite to be disposed of within a period of three months from the next dated fixed.

Today, the learned advocate for the petitioner submits that the first paragraph of Page 2 of the order dated September 6, 2023 be corrected by incorporating expeditious disposal of the proceeding under Section 125, pending before the learned criminal court.

This Court does not have supervisory jurisdiction over the said court. Thus, such correction and insertion cannot be allowed.

However, as the learned advocate is not sure as to whether any application for maintenance pendente lite is pending in the matrimonial suit, the entire paragraph being the first paragraph of page-2 with regard to early disposal of the application for maintenance pendente lite be deleted. Let the corrections be incorporated by the department and the same be treated as a part of the earlier order. Rest of the order dated September 6, 2023 remains unaltered. (Shampa Sarkar, J.)
