Having considered the submission of learned advocate for the petitioner seeking expeditious disposal of injunction application under Order 39 Rules 1 and 2 of the Code of Civil Procedure, filed in connection with Misc. Case No.82 of 2011, pending before the Court of learned Civil Judge (Junior Division) 2nd Court, Baruipur, South 24 Parganas, on the ground of long pendency of this interlocutory application, the court is of the view that no prior notice is necessary upon the opposite party, in view of the nature of the order proposed to be obtained in this case.

Accordingly, the service of notice upon the opposite party stands dispensed with.

Learned court below is directed to ensure expeditious disposal of pending temporary injunction application, referred above, by giving sufficient opportunity of hearing to either of the parties to this case without granting any unnecessary adjournments, unless it is extremely unavoidable.

Petitioner to make communication of this order to the opposite party/plaintiff and his learned advocate appearing in the court below, apart from making independent communication of this order to the court below.

With this direction, application stands disposed of. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon usual undertakings.
