The petitioner says that he is in custody for 65 days. Charge sheet has been filed. Evidence is in progress. His further detention is not necessary.

Learned Advocate for the State opposes the prayer for bail. He points out that this petitioner was absconding for two years. His complicity in the alleged offence is absolutely clear from the material on record.

From the material on record, we find that the petitioner may be involved in the alleged offence. Commercial quantity of contraband item is involved. Hence, keeping in mind the restrictions in Section 37 of the NDPS Act and also that the trial is expected to conclude at an early date, 10 out of 16 witnesses have already been examined, we are not inclined to enlarge the petitioner at this stage.

CRM (NDPS) 968 of 2024 is, thus, dismissed.
