1. Learned counsel appearing on behalf of the opposite party has undertaken not to press the application under Order 39 Rule 7 of the Code of Civil Procedure before the trial Court.

2. Learned counsel appearing on behalf of the petitioner has submitted that in that case if the application under Order 39 Rule 7 of the Code of Civil Procedure is not pressed by the opposite party, the instant revisional application has become infructuous and the same may be disposed of.

3. With the aforesaid observation the instant revisional application stands disposed of with a direction upon the learned Trail Judge to dispose of the suit pending since 2017, preferably within six months from date of communication of this order.

4. Parties are at liberty to communicate this order to

the learned Trail Judge.

5. With the aforesaid observation, the revisional application stands disposed of.

6. Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.

7. All the parties shall act on the server copy of this order duly downloaded from the official web site of this Court.
