18.07.2024 Sl No. 14 Court No. 29 TN (Allowed) CRM (A) 2033 of 2024 In Re:- An application for anticipatory bail under section 438 of the Code of Criminal Procedure filed in connection with Techno City Police Station Case (FIR) No. 42 of 2023 dated 16.03.2023 under Sections 341/323/352/379/403/406/420/506/34/120B of the Indian Penal Code.

And In the matter of : Niranjan Sahoo and another. - petitioners Ms. Karunamoyee Samanta ....for the petitioners Ms. Zarin N Khan, Mr. J Iqubal Hossain ... for the State

1. We have considered the report filed by the Investigating Officer (IO). It appears that the petitioners have attended the police station and met the IO on 6th July, 2024 and have cooperated with the investigation.

2. Considering the fact that the transaction is essentially commercial in nature and the petitioners have complied with the requisition under Section 41A of the Code of Criminal Procedure, we are of the view that custodial interrogation of the petitioners is not necessary.

3. Accordingly, we direct that in the event of arrest, the petitioners, namely, Niranjan Sahoo and Sabyasachi Sahoo shall be released on bail upon furnishing a bond of Rs.20,000/- each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. 4. The petitioners shall meet the IO once in a fortnight till submission of the final report.

5. It is further directed that the present accused petitioners shall appear before the learned Chief Judicial Magistrate at Bidhan Nagar in connection with G.R. No. 747 of 2023 within two weeks from date and pray for regular bail.

6. Accordingly, the application for anticipatory bail is disposed of.
