Affidavit of service filed by the petitioner is taken on record.

Petitioner is aggrieved by the inaction of the police authority as no step was taken pursuant to the information furnished on 22.06.2025.

State has submitted a report which reflects that over the self-same incident the wife of the petitioner no.1 submitted an information with the Police Station pursuant to which Baduria police Station case no. 347 of 2025 dated 01.07.2025 was registered for information.

Learned advocate for the private respondents submit that the dispute is amongst the relation and there is a case under the POCSO Act against the brother of the petitioner no.1.

Learned advocate for the petitioner further alleges that they are unable to enter the residence. Since two criminal cases are existing one which has been initiated at the instance of the wife of the petitioner no.1 and another POCSO case pending before the learned Special Court against one of the relation of the petitioner no.1, I am of the view in case the petitioners are unable to enter the residence, they would prefer appropriate application before the concerned Special Court or the concerned Court having its jurisdiction over Baduria Police Station. Learned Court would in accordance with the provisions of law dispose of the said application within a period of two weeks.

With the aforesaid observation writ petition being WPA 14645 of 2025 is disposed of.

Copy of the report be kept with the record.
