It appears from the report filed in court today by learned counsel for the WBSEDCL, which is kept on record, that the "rail pole" has been erected about five meters away from the boundary wall of Subhas Halder, the writ petitioner.

Although no obstruction is created to his entrance, the report further says, no alternative place for installation of new transformer could be pointed out by the WBSEDCL.

However, it is clearly iterated in the report that the decision has been taken not to install the transformer in that place.

In view of the objection of the petitioner and keeping in mind the tenor of the report, WPA 14984 of 2022 is disposed of by directing the WBSEDCL to install the proposed transformer at a different place than near the petitioner's property.

The erecter pole will be uprooted by the WBSEDCL as expeditiously as possible, positively within three weeks from date.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
