Report submitted by the learned advocate appearing for the State be kept with the record. Petitioner approached this Court for effecting direction in Title Execution Case No. 109 of 2022. According to the petitioner, the FIR which was registered being Belur Police Station Case No. 59 of 2024 dated 18.04.2024, therein no effective steps were taken by the police authorities.

Having regard to the fact that there was a background of civil dispute and Title Execution Case was pending and the police authorities registered case and counter-case being Belur Police Station Case No. 58 of 2024 dated 18.04.2024 and Belur Police Station Case No. 59 of 2024 dated 18.04.2024, I am of the view that if till date the investigation has not been concluded, petitioner would be at liberty to approach the jurisdictional Magistrate. The jurisdictional Magistrate would ensure that the investigating agency within a period of three months have come to their conclusion in respect of the case which was registered for

investigation provided till date the same has not been concluded.

With the aforesaid observations, the writ petition being WPA 15687 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
