Counsel for the DPSC, Howrah has stated that the petitioner may join at any point of time convenient to her. 2.

Counsel for the petitioner submits that the petitioner's resignation as Para Teacher, which is a precondition for joining as an Assistant Teacher in the same school is not being accepted by the Head Master. Communication from the Head Master in this regard is annexed to the writ petition.

In these circumstances, this Court directs the Head Master, Shibgachia Primary School and the District Educational Officer, Samagra Siksha Mission, Howrah to accept the letter of resignation of the petitioner as a Para Teacher in the school forthwith upon the same being tendered.

Upon receipt of the resignation, the District Educational Officer, Samagra Siksha Mission, Howrah

shall immediately issue order of release of the petitioner and communicate the same to the Shibgachia Primary School.

The Head Master of the Shibgachia Primary School shall correspondingly also accept a joining report of the petitioner as an Assistant Teacher.

In the event of non-cooperation by the Head Master, the letter of resignation and joining as indicated above, shall be sent to the Chairman, DPSC, Howrah. The Chairman, DPSC, Howrah upon receipt of any communication as above from the petitioner, shall treat the petitioner as having joined the said school and initiate appropriate proceedings against the Head Master including transfer.

With the aforesaid direction, the writ petition is disposed of.

There shall be no order as to costs.
