Mr. Mrinal Kanti Ghosh ... for the petitioner Mr. Sandipan Banerjee Mr. Sobhan Majumder Mr. Ankit Sureka ... for the Howrah Municipal Corporation The petitioner is aggrieved by the notice dated 18th June, 2022 whereby the petitioner has been directed to self-demolish the portions which have been constructed in deviation of the sanctioned plan.

A perusal of the said notice makes it clear that the portion where there are deviations is not mentioned in the said notice.

It may be difficult for the petitioner to identify the portions which have been considered as unauthorised by the Howrah Municipal Corporation.

In view of the above, the impugned notice dated 18th June, 2022 is accordingly set aside.

The respondent no.5 is directed to intimate the petitioner the nature and extent of the deviations that has been made so that the deviated portion can be

identified and demolished by the petitioner. The details shall be supplied to the petitioner at the earliest but positively within a period of eight weeks from the date of communication of this order.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
