Learned Counsel for the petitioner/complainant is aggrieved by the fact that the case was instituted in the year, 2017 but till date out of three witnesses which the complainant intends to tender for evidence before charge is framed, only one witness has been examined partially.

Having regard to the compulsions involved in the cases instituted by way of warrant cases otherwise than on police report, I am of the view that adequate care should be taken by the learned Magistrate particularly at the stage of the evidence by

completing the evidence within the schedule period of time adhering to the West Bengal ( Amendment) Act. Having regard to the prayer so advanced on behalf of the complainant, I direct that henceforth no unnecessary adjournment should be granted to either of the parties. All efforts may be taken to fix at least one date in a month so that the evidence before charge is concluded by 31st January, 2024. No unnecessary adjournment be granted to either of the parties. Stakeholders should co-operate to reach the stage of charge within the schedule fixed by this court.

With the aforesaid observations the revisional application being CRR 2285 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server coy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
