Affidavit-of-service filed on behalf of the petitioner is taken on record.

The petitioner seeks an electricity connection for his residential premises located at 62/E/8, Ram Krishna Road, Rishra, Serampore, Hooghly - 712248. Learned counsel appearing for Calcutta Electric Supply Corporation (CESC) submits that although CESC is willing to provide the electricity connection, the same could not be effected due to obstruction caused by respondent nos. 5 and 6. Learned counsel appearing for respondent nos. 5 and 6 submits that there exists a dispute concerning ownership of the property between the petitioner and the said respondents. However, it appears that both the petitioner and respondent nos. 5 and 6 have purchased their respective portions of the property from a common predecessor-in-interest.

There may be a pending property dispute between the parties; however, such a dispute cannot be a ground to deny the petitioner an electricity connection to his premises.

In view of the above, WPA 14621 of 2025 is disposed of with a direction upon CESC to provide electricity connection to the petitioner within a period of three weeks from the date of this order, with the assistance of the local police, if necessary.

The Officer-in-Charge, Serampore Police Station, is directed to extend necessary assistance to the officials of CESC for the implementation of this order. The cost of police assistance shall be borne by the petitioner. (Kausik Chanda, J.)
