The petitioner is a de facto complainant in respect of Tiljala Police Station Case No.201 of 1999 under Sections 406/420 of the Indian Penal Code. He is aggrieved by the fact that the public prosecutor is not taking steps to enforce the attendance of the principal accused Mr. Rajiv Nandini.

Counsel for the State submits that the trial has commenced under Sections 406/420 of the Indian Penal Code.

The State, particularly the investigating officer and the public prosecutor shall take all necessary steps to enforce the attendance of the accused persons in the Court below.

The respondents may also make an appropriate application to the Ministry of External Affairs for seeking extradition of the accused and for obtaining a Red Corner notice from the Interpol.

Appropriate assistance shall be given by the CID, West Bengal to the Tiljala Police and the Investigating Officer in this regard.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
