And In Re : Roki Halder & Anr. ..........petitioners Mr. Surajit Basu Mr. Samudra Nil Sarkar Ms. Barnali Mukherjee ..... for the petitioners Mr. Arijit Ganguly Mr. Koushik Kundu .... for the State Learned Counsel for the petitioners is directed to serve copy of this application to Mr. Arijit Ganguly, learned Counsel, who ordinarily appears on behalf of the State. His appointment may be regularised by the concerned authorities. Learned Counsel for the petitioners submits that they were granted bail by the learned Chief Judicial Magistrate, North 24 Parganas, however, because of miscommunication they could not appear on the date so fixed and as such warrant of arrest issued against them.
In view of submission advanced by the learned Counsel for the petitioners and the undertaking given by them and as the petitioners submit they would co-operate with the proceedings before the learned trial court, I direct that in case the petitioners were on bail and if they surrender and appear before the trial
court on or before 14th July, 2023 they would be allowed to continue on the same bail and bond. Learned Magistrate would be at liberty to impose any other condition, if he thinks, it would be fit and proper for ensuring the presence of the petitioners in future. In case the petitioners do not surrender by 14th July, 2023 the learned Magistrate would be at liberty to issue harsher process of law on the next date.
With the aforesaid observations the revisional application being CRR 2288 of 2023 is disposed of.
Pending connected application, if any, is consequently disposed of.
All concerned parties shall act on the server coy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
